1. Mandatory Product Registration and Condition Precedent to Warranty

The activation, validity, and enforcement of any product warranty associated with the SAFE ESCAPE - YOUR RESCUE PARTNER™ Controlled Safety Descend Device are strictly conditional upon the successful completion of the online product registration process by the Customer. The Customer must accurately populate all mandatory purchase details, installation parameters, and specific site location coordinates on the official website of SAFE ESCAPE - YOUR RESCUE PARTNER™. Submitting this registration form and clicking “I Agree” constitutes an absolute, binding, and irrevocable electronic contract under the Information Technology Act, 2000. Failure to register the device within fifteen (15) calendar days of physical installation completely voids any potential warranty claims, structural support obligations, or customer service avenues, rendering the product entirely unsupported by Innovative Ideaz Global Private Limited / SAFE ESCAPE - YOUR RESCUE PARTNER™.

2. Unilateral Right to Amend and Modify Terms

Innovative Ideaz Global Private Limited reserves the absolute, unrestricted, and unilateral right to alter, modify, amend, delete, or replace any portion of these Terms and Conditions at any time without prior individual notice or intimation to the Customer. Any such amendments will become instantly effective upon being published on the Products website. The Customer explicitly agrees to be bound by the most current version of these terms. It is the sole responsibility of the Customer to periodically review the website for regulatory or operational updates. Continued retention, possession, or deployment of SAFE ESCAPE - YOUR RESCUE PARTNER™ following any posted modifications constitutes irrevocable acceptance of the revised terms by the Customer, their agents, and their institutional successors.

3. Explicit Regulatory Disclosure and Voluntary Acceptance of BIS Status

The Customer acknowledges that they have been explicitly and transparently informed that SAFE ESCAPE - YOUR RESCUE PARTNER™ is an imported product and does not possess a domestic license, registration, or certification from the Bureau of Indian Standards (BIS). The Customer confirms that the purchase and deployment decisions are made voluntarily, with full awareness of this specific regulatory status. The Customer agrees that the provision by Innovative Ideaz Global Private Limited of raw material test reports and static load evaluations from a National Accreditation Board for Testing and Calibration Laboratories (NABL) accredited facility accepts the components to be of high quality.

4. Absolute Exclusion of Structural and Anchoring Liability

Innovative Ideaz Global Private Limited, its directors, distributors, dealers, employees, and technicians carry zero liability for the physical mounting surface, substrate, anchoring bolts, or building facade used to secure the device. The Customer bears sole, absolute, and unshared responsibility for executing a professional structural evaluation of the wall, window frame, concrete beam, or pillar chosen for installation. The Customer warrants that the selected building element can fully withstand the extreme, sudden dynamic loads exerted during an emergency descent. Innovative Ideaz Global Private Limited, its directors, promoters, officers, employees, agents, installers, distributors, dealers, franchisees, representatives, technicians, contractors, affiliates, successors, and assigns are completely absolved from any civil or financial liability if the mounting surface shears, cracks, detaches, or collapses during deployment.

5. Complete Limitation of Civil and Commercial Liability

Under no circumstances shall Innovative Ideaz Global Private Limited, its directors, promoters, officers, employees, agents, installers, distributors, dealers, franchisees, representatives, contractors, affiliates, successors, and assigns be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising from the storage, deployment, failure, or performance of SAFE ESCAPE - YOUR RESCUE PARTNER™. This total limitation of liability applies to all claims, whether based on contract, tort, strict product liability, or breach of implied warranties. The total monetary liability of Innovative Ideaz Global Private Limited for any verified product defect is strictly limited to the invoice amount paid by the Customer for that single specific unit, completely excluding any claims for business interruption, property damage, personal injury, or wrongful death.

6. Absolute Waiver of Criminal Liability and Negligence Claims

The Customer explicitly agrees that Innovative Ideaz Global Private Limited and its directors, promoters, officers, employees, agents, installers, distributors, dealers, franchisees, representatives, contractors, affiliates, successors, and assigns share no criminal liability, culpability, or responsibility under the Bharatiya Nyaya Sanhita (BNS) or any other regional penal laws for any accident, injury, or fatality resulting from the use or deployment of the device. The Customer, for themselves and on behalf of their legal heirs, executors, and administrators, completely and permanently waives all rights to file criminal negligence complaints, legal charges, or First Information Reports (FIRs) against the directors or promoters of Innovative Ideaz Global Private Limited. SAFE ESCAPE - YOUR RESCUE PARTNER™ is accepted as a voluntary emergency addition, and its operational execution is performed at the sole risk of the user.

7. Strict Product Lifespan, Expiry, and Mandatory Decommissioning

SAFE ESCAPE - YOUR RESCUE PARTNER™ is engineered with a definitive, non-extendable operational safety lifespan of exactly five (5) years from the date of physical installation, which serves as the absolute Expiry Date of the product. Upon reaching this five-year Expiry Date, the device automatically becomes legally obsolete, and the Customer is mandated to immediately decommission, remove, and destroy the unit. Any continued deployment, mounting, storage, or utilization of the device past this five-year window completely terminates all company warranties, voids all performance expectations, and permanently expunges all legal liabilities of Innovative Ideaz Global Private Limited and its Directors, Dealers and Employees. Innovative Ideaz Global Private Limited carries no tracking or notification obligation to warn the Customer of the impending Expiry Date.

8. Third-Party Flow-Down Indemnity and Duty to Warn

If the Customer is a corporate entity, hotel, commercial complex, or residential building society, they assume full, exclusive liability for all third-party users, including employees, guests, tenants, and all kinds of visitors. The Customer is legally obligated to place prominent, clear usage instructions and highly visible safety warning signs directly adjacent to the device installation site. The Customer explicitly agrees to fully indemnify, defend, and hold harmless Innovative Ideaz Global Private Limited and its directors, officers, employees, agents, installers, distributors, dealers, franchisees, representatives, contractors, affiliates, successors, and assigns against any legal claims, lawsuits, consumer court disputes, damages, or financial demands raised by any third-party user or their legal representatives.

9. Emergency Single-Use Classification and Drill Restrictions

SAFE ESCAPE - YOUR RESCUE PARTNER™ is strictly classified as a severe emergency-use evacuation asset designed solely for critical, life-threatening scenarios. It must never be utilized for unmonitored routine fire drills, casual building maintenance, training exercises, or recreational practice. Any unauthorized mechanical deployment or line extension outside of a genuine, documented emergency instantly voids all performance warranties and structural integrity assurances. Following any single emergency deployment, the unit must be immediately withdrawn from service, defaced to prevent reuse, or shipped back to the corporate facilities of Innovative Ideaz Global Private Limited for complete factory-level destructive testing and recalibration at the Customer's expense.

10. Strict Adherence to Mechanical Specifications and Maintenance Overhauls

The operational integrity of SAFE ESCAPE - YOUR RESCUE PARTNER™ is strictly dependent upon rigid conformity to its engineered thresholds. The Customer warrants that the device shall never be subjected to deployment beyond its specific purchased wire rope length or structural specifications. Furthermore, the Customer commits to executing mandatory routine visual checks and formal maintenance inspections as detailed by the Company. Any failure to strictly maintain the device, or any unauthorized modification, repair, or tinkering with the internal braking assembly, cable layout, or housing chassis by non-empanelled entities shall instantly terminate all warranties and permanently expunge all corporate liabilities.

11. Absolute Last-Resort Conditionality and Prior Emergency Services Activation

The deployment of SAFE ESCAPE - YOUR RESCUE PARTNER™ is legally authorized exclusively as an absolute measure of last resort during a severe, life-threatening fire accident where all standard emergency exit stairwells, fire lifts, and architectural escape routes are entirely blocked or inaccessible. As a mandatory condition precedent to usage, a formal emergency distress call and complaint must be immediately registered with the local fire department prior to the deployment of the device. Innovative Ideaz Global Private Limited carries zero liability if the device is activated prematurely before standard professional fire rescue avenues have been actively contacted and summoned to the high-rise site.

12. Complete Exclusion for User Operational Errors and Descent-Related Injuries

Innovative Ideaz Global Private Limited is completely absolved of all civil, criminal, and financial liability for any damage, structural failure, bodily injury, or fatality caused by user error or improper operational handling. This strict exclusion encompasses, but is not limited to: failure to securely fasten the safety harness or belt, deploying the device with a load exceeding the maximum rated limit of 100 kilograms, attempting simultaneous multiple-person descents on a single line, or failing to properly bind or secure an infant/child descending in tandem with an adult. The Customer further accepts that minor friction burns, abrasions, scratches, or impact injuries sustained against the building facade during descent are inherent risks of emergency evacuation and cannot form the basis of any legal claim against the Company.

13. Disclaimer for Psychological Panic, Situational Shock, and Pre-Existing Health Conditions

The Customer explicitly acknowledges that high-altitude emergency descent involves extreme situational stress, physical exertion, and psychological distress. Innovative Ideaz Global Private Limited and its directors shall not be held liable for any secondary medical emergencies, temporary or permanent incapacitation, or wrongful death resulting from user panic, vertigo, shock, fainting, or pre-existing medical conditions such as cardiac arrest, hypertension, or pregnancy triggered during or immediately after the deployment of SAFE ESCAPE - YOUR RESCUE PARTNER™. The device is accepted strictly as emergency mechanical hardware, and the psychological and medical fitness of any individual attempting a descent remains the sole risk and liability of the user and the purchasing entity.

14. Governing Law, Dispute Resolution, and Exclusive Jurisdiction

These Terms and Conditions, along with the complete operational relationship between Innovative Ideaz Global Private Limited and the Customer, shall be governed, interpreted, and construed exclusively in accordance with the laws of India. Any legal disputes, consumer court filings, arbitration proceedings, or litigation arising directly or indirectly from this product, its registration, or its deployment shall be subject to the exclusive jurisdiction of the competent courts located in Delhi / New Delhi, India, to the explicit exclusion of all other regional, national, or international courts.
